The punishment for a Reynolds man who failed in his attempt to break into a Logansport business became official Monday.
In Cass Superior Court II, Judge Rick Maughmer accepted terms of a plea agreement in the case of 21-year-old Justin Adran Warren and sentenced him to three years on home detention.
In October, Warren admitted to trying to break into the Dollar General store in Eastgate Plaza on the night of Oct. 20, 2007. His confession allowed him to avoid trial and a possible prison sentence.
According to Deputy Prosecutor James Ackermann, the store manager noticed someone jamming a metal bar beneath the doors, trying to pry them open. Police responded to the scene and captured Warren nearby.
Warren testified that he was going to steal the cash register if had have gained entry to the store.
Ackermann called the act a “foolish crime.” Warren explained to the judge that he had a “brain fart moment.”
Warren’s plea deal called for a three-year term for the class D felony charge of attempted theft. In exchange for the plea, the prosecution agreed to drop a class C felony burglary charge, as well as a misdemeanor count of resisting law enforcement.
Warren received credit for 24 days of time served in the Cass County Jail. The cost to remain out of prison will be an estimated $14,000, if he is accepted into the program. If denied home detention, the judge said, Warren will serve his sentence in the Indiana Department of Correction.
