A federal drug case was dismissed last week for one of the defendant’s in the area July drug bust.
The federal charge of conspiracy to distribute controlled substances and/or marijuana was dismissed for Christopher Calisto of Twelve Mile, in a 14-defendant case all connected to the arrest of Jose Patlan of Logansport. Five of the remaining 14 defendants, Patlan included, have pleaded guilty with plea agreements and the remaining defendants are scheduled to face an April 23 trial.
The 14 defendants were indicted in August 2012 by a grand jury in U.S. District Court after they were arrested in a drug bust involving Indiana and Illinois.
Calisto’s attorney, Matthew Barrett, wrote in an email the U.S. Attorney agreed to dismiss the indictment after being in negotiations with Barrett.
The motion to dismiss the case was filed two days before a hearing in which Barrett wrote that he would have challenged the inclusion of wiretap evidence in the case.
Patlan was the subject of the state wiretap, according to probable cause affidavits.
Barrett wrote that he and his client were happy with the outcome.
“Chris and I are very pleased that the U.S. Attorney’s Office agreed to dismiss him from the case,” Barrett wrote. “Chris has always maintained his innocence in this matter and looks forward to moving on with his life.”
