Plea proposed in sex case of Cass County man

William J. Lemmon could receive six months of in-home detention

A Cass County man could avoid any prison time for exposing himself to young boys and showing them pornographic material if a judge approves a recommended plea bargain.

William J. Lemmon, 43, Lucerne, entered into the plea Friday in Howard Superior Court 4.

If granted by Judge George Hopkins, Lemmon will plead guilty to a Class C felony vicarious sexual gratification. In exchange for his plea, Howard County Prosecutor James Fleming agreed to dismiss four Class D felony counts of dissemination of material harmful to minors.

The plea calls for Lemmon to be sentenced to four years in prison, all suspended except for six months of in-home detention with the condition he have no contact with his victims.

A C felony conviction carries anywhere between two to eight years and a D felony carries up to three years in prison upon a conviction.

Lemmon is being represented by Jay Hirschauer of Logansport.

Judge Hopkins took the matter under consideration Friday and set possible sentencing for July 24.

The charges accuse the semi driver of exposing himself to two boys and showing pornographic magazines and movies to the boys and two young girls in 2007, state police reported.

The alleged incident took place in Lemmon’s semitrailer during a trip to Indianapolis and when it was parked in the children’s driveway near Russiaville, according to the charging information.

State police began investigating Lemmon after the parents of one of the victims called police when they learned of his alleged actions, Detective Tony Frawley of the Peru Post reported.

Lemmon also has charges pending in Cass County in an unrelated case involving contributing to the delinquency of a minor, Frawley said.
