The jury trial scheduled today for a former Galveston clerk-treasurer accused of a hit and run has been delayed because of a conflict with one of the prosecution witnesses.
Christine Lewis, 46, is now set for trial Feb. 12 in Cass Superior Court I on a charge of failure to stop after an accident resulting in serious bodily injury, a class D felony. Police say she was the driver of a car that hit 21-year-old Trey McCulley on Sept. 2, 2011, as he was crossing Ind. 218 near Lewis Cass Junior-Senior High School. The crash is reported to have broken McCulley’s leg.
Cass County Deputy Prosecutor Linsday Ruby filed the motion for a delay, saying one of the state’s witnesses was unavailable for the trial date but available for video deposition in January, according to court documents.
The state also filed a motion to record the video deposition stating that “the evidence will be lost” if the witness’s statements are not preserved and if Lewis is not able to confront the witness.
Lewis is represented by attorney Kelly Leeman. Her former attorney, Jay Hirschauer, withdrew his appearance in September.
The charge carries a possible penalty of six months to three years in prison and a fine of up to $10,000.
